Terms of Use and Sale

These Terms of Use and Sale (“Terms”) govern your access to and use of the Adams Pills website (the “Site”), as well as purchases made through the Site. Adams Pills is a product brand operated by Eros USA Inc. In these Terms, “Eros USA,” “we,” “us,” and “our” mean Eros USA Inc.
By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
1. Adults Only
The Site and Adams Pills products are intended solely for adults. You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater, to access adult-oriented content or purchase products from us.
By using the Site, you represent that you meet these requirements, have not previously been suspended or removed from the Site, and will not permit a person under the legal age in their jurisdiction to access adult-oriented content through your account or device.
2. Privacy
Your use of the Site is governed by the Adams Pills Privacy Policy, which is incorporated into these Terms by reference.
3. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Site with a revised Effective Date. Changes apply prospectively from the date posted, unless otherwise required by law.
4. Permitted Use of the Site
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for lawful, personal, and non-commercial purposes.
You may not copy, reproduce, distribute, modify, sell, rent, exploit, scrape, crawl, harvest, automate access to, interfere with, or gain unauthorized access to the Site or its content. You may not use Adams Pills or Eros USA trademarks, logos, product images, or other brand materials without our prior written permission.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or used the Site unlawfully.
5. Intellectual Property
The Site and its contents—including text, graphics, photographs, videos, product descriptions, designs, software, trademarks, logos, and other materials—are owned by or licensed to Eros USA and protected by applicable intellectual-property laws.
Nothing in these Terms transfers ownership of intellectual-property rights to you.
6. Product Information, Availability, and Pricing
We try to present accurate product descriptions, pricing, availability, and images. Errors may occur. We may correct errors, update information, limit quantities, refuse or cancel orders, or change prices at any time before shipment.
Prices, promotions, and availability may change without notice.
7. Taxes
We collect sales, use, and similar taxes when required by applicable law. Taxes shown at checkout may vary based on the shipping destination, product type, and applicable law.
8. Orders, Cancellations, and Address Changes
An order is not accepted until we process it and prepare it for shipment. We may decline or cancel an order when permitted by law, including because of product unavailability, pricing errors, suspected fraud, or violation of these Terms.
Once an order has been placed, we may be unable to edit its items. If you need to remove an item, the order may need to be cancelled. If you wish to add an item, a separate order may be required.
You may request cancellation before shipment tracking information has been confirmed. Once an order has been released for shipment or shipped, it cannot be changed or cancelled.
Address changes may be granted before shipping confirmation is issued. Please review your shipping address carefully and contact us promptly if it is incorrect.
9. Shipping, Delivery, Returns, and Refunds
Shipping times and delivery dates are estimates unless we expressly state otherwise. Delays may occur because of carrier issues, weather, customs, inventory, payment verification, or events outside our reasonable control.
Our shipping, return, refund, and customs policies apply to applicable orders and are incorporated into these Terms. In general, returns must be unopened and unused and requested within 30 days of delivery. A 5% restocking fee may apply. Unauthorized returns may be refused or returned to sender at the customer’s expense.
For international orders, the buyer is responsible for applicable duties, taxes, import charges, customs brokerage fees, and other border-related charges. We cannot lower or alter customs declaration values.
10. Subscriptions and Recurring Orders
If you enroll in an Adams Pills auto-ship or recurring-order program, you authorize us to charge your selected payment method at the frequency and price clearly disclosed at checkout, plus applicable taxes and shipping charges.
You may cancel a subscription using the cancellation method provided at checkout or by emailing info@adamspills.com. To avoid the next scheduled shipment and charge, submit your cancellation request at least 48 hours before the next processing date. Cancellation requests received after an order has begun processing may apply to the following cycle.
11. Third-Party Services and Links
The Site may contain links to third-party websites, services, payment providers, or shipping carriers. We do not control and are not responsible for third-party content, availability, policies, or practices.
12. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” We do not guarantee that the Site will always be available, uninterrupted, secure, error-free, or free of harmful components.
Nothing in these Terms limits consumer rights that cannot legally be excluded or limited.
13. Limitation of Liability
To the fullest extent permitted by law, Eros USA and its officers, employees, affiliates, licensors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site or purchase of products.
To the fullest extent permitted by law, our total liability for a claim relating to the Site or an order will not exceed the amount you paid to Eros USA for the applicable order giving rise to the claim.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Eros USA and its officers, employees, affiliates, and service providers from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the Site, violation of these Terms, or violation of another person’s rights.
15. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York, unless applicable law requires otherwise.
16. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent.
